Shipping Policy
This Shipping Policy ("Policy") governs the shipment, delivery, returns, and exchanges of products purchased through The Penguin Method, LLC's website (the "Website"). By placing an order, you agree to the terms herein, which supplement our Terms of Service and any referenced policies. Capitalized terms not defined herein shall have the meanings ascribed in the Terms of Service.
1. Address Verification and Delivery Requirements
To ensure accurate and timely delivery, you must verify and provide complete shipping address information before order confirmation, including, but not limited to, street names, building or apartment numbers, abbreviations, route details, and any other pertinent information. You acknowledge that incomplete or inaccurate address details may result in delivery delays, misdelivery, or loss, and agree to assume responsibility for such outcomes.
2. Liability for Delivery Errors
We shall not be liable for any orders that are lost, misdelivered, or undelivered due to inaccurate or incomplete shipping address information provided by you at the time of purchase. In the event an order is returned to our facility as "returned-to-sender" due to such errors, we will reship the order to a corrected address upon your request and payment of any additional shipping fees, subject to product availability. Reshipment shall occur within a reasonable time after receipt of the returned item, not to exceed thirty (30) days, absent extenuating circumstances.
3. Returns and Exchanges
A. Eligibility and Restrictions
Returns and exchanges are subject to this Policy and our Returns Policy. All sale items are final sale and ineligible for refund or exchange. Only items purchased at the regular price are eligible for a refund, provided they meet the conditions below. We reserve the right to deny returns or exchanges that do not comply with this Policy.
B. Exchanges for Defects or Damage
Exchanges are available solely for items that are defective or damaged upon receipt, as determined in our reasonable discretion following inspection. To initiate an exchange for the same item, contact us at happy@penguin-method.com within thirty (30) days of delivery, providing proof of defect or damage (e.g., photographs). We will inspect the returned item within a reasonable time, not exceeding fourteen (14) days from receipt, and, if verified, ship a replacement at our expense. If a replacement is unavailable, we may issue a refund at our discretion. This remedy is in lieu of all other remedies unless it fails its essential purpose.
C. Return Shipping Costs
You are responsible for all return shipping costs, including any duties or fees. Original shipping costs are non-refundable, except where the return is due to our error (e.g., shipment of incorrect or defective items). If a refund is issued, return shipping costs will be deducted from the refund amount, unless waived due to our fault.
D. Transit Times
Transit times for exchanged or reshipped items may vary based on your location, carrier availability, and external factors (e.g., weather or customs delays). Estimated times are not guarantees, and we shall not be liable for delays beyond our reasonable control.
E. Tracking and Insurance Recommendations
For returned items valued over $75, we recommend using a traceable shipping method or purchasing insurance. We cannot guarantee receipt of untracked or uninsured returns and disclaim liability for losses in transit.
4. General Provisions
This Policy is governed by the laws of the State of Wyoming, without regard to conflict of laws principles. Any disputes arising hereunder shall be resolved through binding arbitration in Wyoming under the rules of the American Arbitration Association, unless otherwise agreed. If any provision is held invalid, the remainder shall remain enforceable. We may update this Policy by posting notice on the Website or by email; continued purchases constitute acceptance.
